SUIT FOR DECLARATION AND
MANDATORY INJUNCTION.
Respectfully Sheweth:-
1.
That the correct name of the
plaintiff’s father is Muhammad Zaman Gujar Butt which is evident from ID Card,
NADRA Record and other relevant documents, annexed with the plaint.
2.
That Muhammad Zaman Gujar
Butt son of Mehmood Alam died on __________ leaving behind the legal heirs as under:-

Zafran Khan Plaintiff

Rehan Alam sons
c.
Rizwana Kausar daughter
3.
That the deceased namely Muhammad
Zaman Gujar Butt contracted only one
marriage with Zaib un Nisa during his
life time. Parents and his wife of the deceased have already died

That the name of plaintiff’s
father has been wrongly incorporated in the Revenue Record as Bilal Ahmed whereas
actual name of plaintiff’s father is Muhammad Zaman Gujar Butt. It is result of
clerical mistake on the part of the defendants. The correct name of the
plaintiff’s father is Muhammad Zaman Gujar Butt which is evident from above
said documents.

That now the plaintiff has
come to know about the mistake to the effect that name of the plaintiff as well
as his father has been wrongly recorded.
6.
That the defendants have been
asked to correct the name of the plaintiff’s father is Muhammad Zaman Gujar
Butt instead of Bilal Ahmed in their record with the correct parentage, but
they refused, hence this suit.
7.
That the cause of action
accrued to the plaintiff against the defendants a week ago upon final refusal
of the defendant and is continuing day by day.

That the offices of
defendants are situated in

That the value of the suit
for the purpose of court fee and jurisdiction is Rs.20,000/- and no court fee
is payable.
It is, therefore, prayed that a decree
for declaration to the effect that the correct name of the plaintiff’s father
is Muhammad Zaman Gujar Butt and
for mandatory injunction directing the defendants to correct the name of the
plaintiff’s father as Muhammad Zaman Gujar Butt in their revenue record and to issue FARD with
the said correct name, may be passed in favour of the plaintiff and against the
defendants with costs.
Any other relief deemed fit and proper by
this Honorable Court be also very graciously passed in favour of the plaintiff.
