Subject:   Human Rights Case No. 69229/2018 in Matter regarding functioning of Patwari, Kanungos and Tehsildars in Urban Area.

 

 

I am directed to refer to this Department Letter No. Rev: VII/Human Rights Case No. 69229-P/2018 ----83 dated 27-02-2019 followed by reminders bearing No. Rev: VII/Human Rights Case No. 69229-P/2018 11409-15 dated 04-04-2019 and Rev: VII/H.R Case 2018----- dated 26-08-2019 Copy enclosed on the subject and to state that the Competent Authority  has taken serious notice of the facts that directions of Apex Supreme Court of Pakistan on the case titled Human Rights case No. 69229-P/2018 and the  subsequent directions issued by the Board of Revenue, but mostly Patwaris, Tehsildars, carving out transfer of property through mutations on the ground that their areas are not falling in the-------- of Laal Lakeer and the direction f Apex Supreme Court of Pakistan and  instructions of Board of Revenue are not  complied with in letter and spirit and mutation for the purposes of the transfer of properties are still being  carried out in urban areas, municipality towns etc already notified by the local Government Department.

 

 

It is therefore once again reiterated that the Revenue Record Patar Khanas can only be maintained for record keeping and not for the transfer of property under any modes recognized by the Transfer of Property Act or any other law preset at the time of urban areas.

 

All the Deputy Commissioners of Khyber Pakhtunkhuwa with are ex-officio District Collector as well as District Registrar are directed to ensure that all mutations are completely banned in urban areas / limits and the transfer of properties in urban limits takes place only through registered sale deed and compliance report be submitted to this department at the earliest.
