Format of Legal Notice for payment of property on installments

 

When a person purchases a Property/ house on installments but does not pay the due installments, a Legal Notice can be sent to such person defaulter of installments. Following is the sample of legal notice about property purchased on installments.

Subject :       Legal Notice

 

 I have been instructed by client _________________ to serve you with the following legal notice.

 

1.            That the “___________” is a project for construction of houses and to allot to purchasers on installments to mediocre people and also on cash basis. For the said purpose, many persons applied and got transferred the houses through registered sale deeds and also entered into agreements on installments.

2.            That you also approached to my client for the purchase of house on monthly installment in said project. The terms and conditions of the allotment were duly provided to you, which you read and signed and then agreed to purchase the house on monthly installments. My client on behalf of ___________executed an agreement with you on 05-09-2015 in respect of House _____________in consideration of Rs. 29,00,000/- whereby you paid an amount of Rs. 6,00,000/- and it was settled that you will pay the remaining amount in monthly installments @ Rs. 15,000/- on or before 5th of each month. It was also agreed in the agreement that in case of non-payment of three consecutive monthly installments, the firm can cancel the agreement.

3.            That you failed to comply with the terms and conditions of the agreement and failed to deposit the monthly installments since 2016. Due to default in payment of monthly installments, my client has a right to cancel the agreement taking action according to the terms and conditions of the agreement.

4.            That in good faith, my client gives you grace period of 15 days for deposit of arrears of installments along with penalty and for deposit of future monthly installments without any fault.

5.            That through this notice, you are hereby called upon to deposit the arrears of installments along with penalty within 15 days after issuance of this legal notice and also to ensure deposit of future monthly installments without any default, otherwise you agreement will be cancelled and my client will be at liberty to proceed further in accordance with the terms and conditions of the agreement and to proceed before the court of competent jurisdiction at your risk and costs.
