SUBJECT: LEGAL NOTICE
That I have been instructed by my client ________________to serve you the following legal notice.
1.
That
on 13-03-2015, at about _____ PM you along with _____(your real brother), ___(your
real nephew) and some other un-known persons, on gun point forcibly took my
client to a stamp vendor, Saim Saleem, Kallar Syedan, District Rawalpindi,
where you illegally, unlawfully and without consent of my client and got issued a stamp paper for agreement to sell in the name of my client bearing
serial No. 399 dated 13-03-2015.
2.
That
on the above said stamp paper, an
agreement to sell was written in which a
piece land measuring 4 Kanals 19 Marlas bearing Khasra No. 209, Khewat No. 489 situated
at Mouza Kallar Syedan, District Rawalpindi is shown to have been sold by my
client to you against sale consideration of Rs. 5,00,000/- and an amount of Rs.
4,00,000/- is also stated to have been received by my client from you.
Remaining amount of Rs. 1,00,000/- is shown payable on or before13-04-2015.
3.
That
it is worth mentioning here that you along with other co accused while
extending threats of being killed, forcibly took signature and thumb
impressions on the said stamp paper/ agreement to sell.
4.
That
the original stamp paper/agreement to sell is lying with you and you even did
not provide its photocopy to my client.
5.
That
my client has never sold the said land, nor receive any sale consideration.
Furthermore, said stamp paper/agreement to sell has not been written, signed
and thumb impressed and executed by my client with his free will and consent hence
same is a forged document which you are bound to handover to my client in
original.
Therefore, through this legal notice you are directed to handover the original stamp paper/agreement to sell bearing serial No. No. 399 dated 13-03-2015 to my client within 15 days after receipt of this legal notice Otherwise my client have instructed me to file a civil as well as criminal proceedings against you at your own risk and costs.
Note: A copy of this legal
notice is retained in my office for record and further necessary actions.
