In the name of ALLAH, the most beneficent, the most merciful

 

If your bank has rendered deficient services, as a result of which, you have sustained financial losses, you can take legal proceedings against the concerned bank.  Before filing a complaint to Banking Mohtasib (Ombudsman), you should send the concerned Bank a Legal Notice for redressal of your grievance and your intention. Following is the sample of Legal Notice sent to Bank.

LEGAL NOTICE

 

This notice is served to you under section 82-D (2) of Banking Mohtasib (Ombudsman) Pakistan, which states as under:-

 

“Prior to making a complaint, the complainant shall intimate in writing to the concerned bank his intention of filing a complaint and if the bank either fails to respond, or make a reply which is unsatisfactory to the complainant, within a period of forty-five days, the complainant may file a complaint at any time thereafter, within a further period of forty-five days”

      

 

1.            That my wife _____________ sent two remittances in GBP of amount __________on ____________and ____________on ____________in my Bank account ________________ account title “______________________” from her Bank account _________________The said transaction was legitimate and justifiable.

 

2.            That the bank instead of transferring the above mentioned amount into the undersigned beneficiary’s GBP account number as originally sent, the bank started giving extremely lame & flimsy excuses and delayed gratuitously and intentionally, by which, the undersigned suffered a huge loss of _________________as a result of not executing of the agreement between the undersigned and the third party, on a prescribed date.

 

3.            That the undersigned requested the bank several times through telephonic messages,  by sending personal messengers to the bank, meeting you in person for number of occasions with a request to release the said outstanding payment but you have always been dilly delaying the same on one pretext or the other and so far not paid  full amount.

 

4.            That the bank transferred the amount after a long delay of ____days and in the beneficiary’s PKR Account No. _____________________title “_____________________” instead of beneficiary’s GBP Account No. _____________________title “_____________________, the amount transferred in beneficiary’s PKR Account was not even appropriate amount and the exchange rate given by the bank, was unreasonable, which is outrageously unsanctioned, interdicted and forbidden by law. This is a great malafide on the part of the bank that instead of transferring the amount in the beneficiary’s GBP account, the amount was transferred in beneficiary’s PKR account due to the ulterior motives of the bank officials.

 

5.            That it is pertinent to mention at this juncture that it is quite strange that despite our repeated requests, to the bank, to send money back to the sender, if it is not possible to credit the amount in beneficiary GBP account but our this authentic request was overlooked by the bank because of surreptitious and covert motives, which is a defraud, depriving of the right of the beneficiary and trickery with the undersigned.

  

6.            That thus you are liable to pay the damages, compensation along with the remaining amount to the undersigned and I am entitled to recover the same from you because the bank given -severely obdurate, dreadful, stony-hearted and flinty mental torture and agony in last two  weeks through their amateurish and lax leanings. Their unpersuasive, feeble and frangible vindications were terribly spanking the perspicaciousness and mind which given psychotic ailment.

 

7.            That inspite of acknowledging the liability of payment of principle amount, you have been miserably failed to make payment of the amount to the undersigned on time as per the directions of the State Bank of Pakistan.  The bank deliberately with malafide intent, given an enormous monitory loss, hence you are liable to pay the principle balance amount along with interest from the date of due, till actual realization of the said sum as in generally and customarily prevailing the trade usage, along with compensation.  

 

It is requested to you to pay the losses as follows:-

In case of failure to comply with this notice within a period of 45 days of the receipt of this legal notice, you shall render yourself jointly and severally liable to face appropriate civil as well as criminal proceedings under the relevant provisions of law at your risks as to cost and consequences. A copy of this legal notice has been preserved in my office for the record and future course of action and you are also advised to keep the copy of the same as safe as you would be asked to produce in the competent court of jurisdiction.
